There's barely any source code for the RTP software except for the installation kit. There's honestly no need to reverse-engineer or alter it...
But the main point in the text was "Further, Licensee shall not sell, distribute, assign, lease, sublicense, encumber, or otherwise transfer the RTP SOFTWARE and/or its data without any prior written consent of ENTERBRAIN."
Of course it's not right to sell the RTP software, but if one were to include it with the commercial game package, would that mean you are distributing its data through a game and therefore breaking the license? I would assume not, but texts written on a paper is highly interpretable; look at the Constitution for Criminey's sake.
